RESOLUTION WHEREAS, in 1999 the Wisconsin State Legislature adopted Act 9, the
biennial 1999-2000 budget act, and WHEREAS, included in this budget act
was comprehensive planning and land-use legislation commonly referred to as
the "Smart Growth" law (Wis. Stat. 66.0295), and WHEREAS, the "Smart Growth" law outlined comprehensive
planning for local governments and included a requirement that by January 1,
2010 a local government unit's land use actions must be consistent with its
adopted comprehensive plan, and WHEREAS, by January 1, 2010 local government's must have completed
and adopted by ordinance a comprehensive plan to be certain that any programs
or actions affecting land-use are valid, and WHEREAS, the "Smart Growth" law also requires comprehensive
planning for receipt of certain state funding, and WHEREAS, the "Smart Growth" legislation will require local
governments to undertake extraordinary efforts and expense to satisfy the
law, and WHEREAS, particularly in rural low growth areas the extensive
comprehensive planning requirements outlined by the "Smart Growth"
legislation are unnecessary and force local governments to expend valuable
tax-payer dollars and time to complete, and WHEREAS, the "Smart Growth" law will unavoidably compromise
private property rights, and WHEREAS, "Smart Growth legislature is another unfunded mandate. NOW THEREFORE BE IT RESOLVED, at the Price County Board of
Supervisors hereby petitions the Governor and State Legislature to rescind
the "Smart Growth" legislation. BE IT FURTHER RESOLVED, that the Price County Board of Supervisors
has determined that the "Smart Growth" legislation is unnecessary
and puts a burden on local governments and taxpayers. BE IT FURTHER RESOLVED, that Price County objects to the tying of any
eligibility for State funding to the adoption of a comprehensive plan by a
local government. BE IT FURTHER RESOLVED, that copies of this resolution be transmitted
to the Governor, the legislators representing Price County, Price County Towns, the Wisconsin Counties Association and all Wisconsin County Boards.
